The 1976 Copyright Act is creating windows of opportunities for authors and heirs to recapture rights in works 35 years after the date of the grant, despite contracts which specify that the transfer was in perpetuity. Works made for hire are an exception. However, authors, estates and heirs should be aware that the right to recapture is only available during a specific time period and will be lost if certain deadlines and statutory notice requirements are not met.
